TERMS OF SALE & PUBLIC OFFER

This document constitutes an official public proposal and Distance Sales Agreement by the independent designer Maria Altukhova, hereinafter referred to as the "Seller", to conclude a sales contract under the terms and conditions set forth below with any legally capable individual or legal entity, whether a resident or non-resident of the country of dispatch (hereinafter referred to as the "Buyer").

1. Terms and Definitions

• Seller — Registered independent artisan and taxpayer Maria Altukhova, engaged in the creation and retail sale of unique author's interior goods.
• Buyer — Any legally capable individual or entity who has placed an Order on the Website under the terms of this Agreement.
• Goods — Collectible handmade author's interior sculptures and goods presented for sale on the Website. All Goods are manufactured by the Seller personally and qualify as artisan crafts exempt from mandatory industrial certification.
• Website — The Seller's internet resource located at: mariaaltukhova.com.
• Order — A completed electronic request by the Buyer for the purchase and delivery of the Goods.
• Acceptance — Full and unconditional acceptance of the terms of this Agreement by the Buyer via making a 100% advance payment.

2. Subject of the Agreement
2.1. The Seller undertakes to transfer ownership of the original Goods manufactured by the Seller personally to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.
2.2. This Agreement regulates online retail sales on the Website, including selection, independent placement, secure payment, and international fulfillment of the Order.

3. Ordering Procedure and Acceptance
3.1. Orders are placed through the electronic forms on the Website or by direct communication via the specified contact details.
3.2. By placing an Order, the Buyer confirms that they are fully familiar with the product specifications, care instructions, and agree to these Terms of Sale.
3.3. Payment for the Goods (Acceptance) establishes a legally binding contract.
3.4. If the chosen item is out of stock, it will be custom-made. Manufacturing timelines for bespoke artisan Goods are non-fixed and are discussed individually via email or messengers prior to payment.

4. Handmade Craftsmanship & Operation Rules
4.1. Artisan Features: The Buyer acknowledges that the Goods are unique, handcrafted pieces. A 100% exact replica is impossible. Minor variations in fabric/velour texture, shades of materials, hand-painted details, or stitching compared to Website photographs are natural characteristics of manual labor and do not constitute defects.
4.2. Collectible Status: All items are collectible author’s interior sculptures designed for aesthetic decoration. They are not children's toys and are not intended for active play.
4.3. Care Rules: The Buyer agrees to gentle care guidelines:

• Dry cleaning only (soft brush or dry cloth to remove dust).
• Washing, machine spinning, wetting, and contact with household chemicals are strictly prohibited.
• Protect the item from direct prolonged sunlight, high humidity, pets, and small children.
• Mechanical damage from improper play or care is recognized as the Buyer's fault and excludes return or exchange options.

5. Price and Payment Procedure
5.1. Prices are determined by the Seller and displayed on the Website in USD or other available currency equivalents. The price of an ordered item is locked upon placement.
5.2. All sales are processed strictly on a 100% secure advance payment basis.
5.3. International payments are integrated via an encrypted processing gateway. Any multi-currency conversions are handled automatically by the acquiring processor and the Buyer's issuing bank at the official transaction exchange rate. No hidden fees are applied by the Seller.
5.4. An automated electronic receipt and order confirmation are generated immediately after a successful transaction and sent to the Buyer’s email address.

6. International Delivery & Logistics
6.1. Goods are shipped only upon receipt of 100% advance payment.
6.2. Shipping is conducted via Priority International Air Mail or international courier networks with full tracking to the door.
6.3. Shipping rates are calculated dynamically at checkout. The Buyer is solely responsible for any destination country customs clearance fees, import taxes, or broker commissions. (Note: Orders to the USA under $800 are exempt from import duties).
6.4. Handling time for in-stock items is 2 to 4 business days. Standard international transit takes approximately 14 to 30 calendar days, subject to regional logistics and customs speed.
6.5. The Seller’s shipping obligation is fulfilled upon handing over the securely packed package to the carrier service, with tracking details instantly sent to the Buyer.

7. Returns and Exchanges
7.1. In accordance with international distance selling regulations, the Buyer has the right to cancel the order before shipment, or request a return within 7 calendar days after delivery.
7.2. Returns of proper quality items are accepted only if the item's marketable appearance is perfectly preserved (no signs of use, scent of perfume, pet hair, or dust), along with its original premium author's packaging and the transaction receipt.
7.3. Shipping Costs Retention: Upon a valid return, the Seller refunds the cost of the Goods minus the original outbound shipping fee and actual processing costs. All return shipping expenses (including international postal rates and return customs duties) are borne entirely by the Buyer. Refunds are processed within 10 days after the Seller physically receives and inspects the returned item.
7.4. Exclusion for Custom Orders: In accordance with international trade standards, Goods custom-made, customized, or personalized according to specific Buyer requirements (individual sizing, custom colors, specific alterations, or personalized inscriptions) possess individually determined properties and are non-refundable and exempt from return or exchange rights, unless a structural manufacturing defect is proven.

8. Quality of Goods and Certification
8.1. The Seller guarantees that the Goods are manufactured personally in compliance with quality standards for author's premium crafts.
8.2. An official Artisan Craft Exemption Letter is available for the Goods, confirming that these collectible interior items are not subject to mandatory industrial certification or declaration of conformity. A copy of the exemption letter can be provided to the Buyer upon request for customs clearance verification.

9. Liability, Applicable Law, and Dispute Resolution
9.1. For non-fulfillment or improper fulfillment of obligations under this Agreement, the parties shall be liable in accordance with international distance selling guidelines and the regulations of the Seller's registration country.
9.2. The Seller is not liable for delivery delays, transit issues, or holds caused by the fault of international postal operators, courier services, or customs inspections in the Buyer's destination country.
9.3. The parties shall endeavor to resolve all disputes and disagreements amicably through negotiations via email or messengers. The mandatory response time to any formal claim is 10 business days. If no amicable agreement is reached, disputes shall be submitted for resolution to the relevant authorities at the Seller's registered location.
9.4. The parties shall be released from liability for non-fulfillment of obligations if it was caused by force majeure circumstances arising after the conclusion of the Agreement due to extraordinary events that the parties could neither foresee nor prevent.
9.5. Force majeure circumstances include: natural disasters, military actions, regulatory acts of state authorities, international sanctions, trade embargoes, or global failures in electronic processing networks and payment gateways.
